WASHINGTON — Matthew G. Whitaker, the acting attorney general, announced on Monday that the special counsel, Robert S. Mueller III, is wrapping up his investigation of Russian interference in the 2016 presidential campaign and whether the Trump campaign cooperated with Moscow’s operation.
“The investigation is, I think, close to being completed, and I hope that we can get the report from Director Mueller as soon as possible,” Mr. Whitaker said.
His impromptu remark, at the end of a news conference about an unrelated case, was a highly unusual confirmation of the state of the special counsel’s investigation. Justice Department policy ordinarily prohibits public comment on open criminal inquiries, and Mr. Mueller has refused to publicly discuss the investigation since he was appointed in May 2017 to oversee it.
Mr. Whitaker, who is considered intensely loyal to President Trump, said that he had been “fully briefed on the investigation” and that he looked forward to Mr. Mueller delivering a report.
Mr. Whitaker’s comments appeared to take even Justice Department officials by surprise. As soon as he described the special counsel’s work as nearly over, a spokeswoman shut down the news conference, declaring hastily: “That’s all the time for today. Thank you so much.”
It was unclear whether Mr. Whitaker had discussed his comments with Mr. Mueller beforehand, or if he was speaking off the cuff. A spokesman for Mr. Mueller, Peter Carr, declined to comment.
Prosecutors typically shy away from discussing the progress of investigations to avoid unfairly framing public expectations, partly because new evidence could unexpectedly arise. Mr. Whitaker acknowledged that tradition before giving his assessment of Mr. Mueller’s progress. “I am really not going to talk about an open and ongoing investigation,” he said.
Mr. Whitaker’s remarks “may be harmless,” said Barbara McQuade, a former United States attorney who now teaches law at the University of Michigan. Nonetheless, she said, “There isn’t any advantage in announcing you are close to the end. You might think that you are close, and then your very last witness leads you to five new witnesses.”
Mr. Whitaker comment’s came on the heels of the indictment of Roger J. Stone Jr., a longtime adviser to Mr. Trump, on Friday on charges of witness tampering, obstruction of justice and lying to Congress about efforts by the Trump campaign to learn about how WikiLeaks might damage Hillary Clinton’s campaign.
The new indictment was issued as Mr. Mueller’s team has pushed other criminal cases toward sentencing, including those against Paul Manafort, Mr. Trump’s former campaign manager, and Michael T. Flynn, Mr. Trump’s former national security adviser.
Mr. Manafort’s sentencing on his conviction on financial crimes, which was scheduled for next month, was delayed on Monday, according to a court filing. No new date was set. He was still scheduled to be sentenced in March in Washington on two conspiracy charges.
In a possible sign that Mr. Mueller could close up shop before Mr. Stone’s case is resolved, prosecutors from outside the special counsel’s team were listed among those who will represent the government in court. Mr. Stone is scheduled to be arraigned on Tuesday in Washington.
Mr. Whitaker has been temporarily leading the Justice Department since Mr. Trump forced Jeff Sessions to resign as attorney general late last year. Mr. Trump’s nominee to replace Mr. Sessions, William P. Barr, is widely expected to be confirmed.
Under Justice Department regulations, Mr. Mueller is required to give the attorney general “a confidential report” explaining his prosecutorial decisions when he has finished his investigation. The attorney general, in turn, must send a report to Congress explaining why the work has concluded, though that can simply be a brief summary.
At his confirmation hearing, Mr. Barr said that if confirmed, he would want to make as much of the special counsel’s report public as possible. But he added that he needed to learn more before making any decisions.
On Monday, two members of the Senate Judiciary Committee introduced legislation that would require the special counsel to report his findings and underlying evidence directly to Congress when the investigation is complete, or if the special counsel is fired.
The bill, written by Senator Richard Blumenthal, Democrat of Connecticut, and Senator Charles E. Grassley, Republican of Iowa, stands little chance of becoming law. Nonetheless, it reflects a strong sentiment in Congress that Mr. Mueller’s findings ought to be aired fully.
Even as they eagerly anticipate those results, lawmakers are plunging ahead with their own investigations. On Monday, another congressional panel, the House Intelligence Committee, announced that it had reached an agreement to question Michael D. Cohen, Mr. Trump’s former personal lawyer and fixer. Mr. Cohen, who has been convicted of financial misdeeds, lying to Congress and violating federal election law, will be queried behind closed doors on Feb. 8 about his work for the president.
The Senate Intelligence Committee has also subpoenaed Mr. Cohen for a private session, and a third panel, the House Oversight and Reform Committee, is weighing whether to subpoena him to testify publicly. Citing concerns about his family’s safety, Mr. Cohen unexpectedly withdrew his offer to testify before the oversight committee next week.
He has also changed his legal counsel, an adviser announced on Monday. Mr. Cohen is replacing Guy Petrillo, a former federal prosecutor in Manhattan, with Michael Monico, a former assistant United States attorney from the Northern District of Illinois, and Barry Spevack, a veteran criminal defense lawyer.B:
